Synopsis As Introduced
Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides an exemption from taxation under the Acts for tangible personal property used in the construction, maintenance, or operation of a public water supply that is operated by a not-for-profit entity. Provides that the Acts' sunset provisions do not apply to these exemptions.

Senate Floor Amendment No. 2
Deletes everything after the enacting clause. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides an exemption from taxation under the Acts for tangible personal property used in the construction, maintenance, or operation of a community water supply that is operated by a not-for-profit corporation that holds a valid water supply permit issued under certain provisions of the Environmental Protection Act. Provides that the Acts' sunset provisions do not apply to these exemptions.

House Amendment No. 1
Deletes the provisions that the exemptions from taxation under the Acts apply to tangible personal property that is used in the operation of a community water supply.

 SB 1360 (H-AM 1) will not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

 This legislation does not create a State mandate under the State Mandates Act.

Balanced Budget Note (Governor's Office of Mgmt & Budget)
SB 1360, if enacted into law, will lead to an unbalanced proposed Fiscal Year 2008 budget. The Department of Revenue estimates a loss of revenue of $1.0 million annually.

 Fiscal Note (Dept. of Revenue)
 SB 1360 would reduce sales tax revenues by approximately $1.9 to $3.15 million per year. Of that cost, approximately $650,000 is from building materials incorporated into community water supplies and approximately $1.25 million to $2.5 million is from equipment used in the construction of community water supplies.

 Fiscal Note, House Amendment No. 1 (Dept. of Revenue)
 SB 1360 (H-AM 1) would reduce sales tax revenues by approximately $1.5 to $2.35 million per year. Of that cost, approximately $650,000 is from building materials incorporated into community water supplies and approximately $850,000 to $1.7 million is from equipment used in the construction of community water supplies.
