Synopsis As Introduced
Amends the Mental Health and Developmental Disabilities Administrative Act. Provides that the Department of Human Services shall establish a system of regular and ongoing on-site inspections of each facility under its jurisdiction including surveillance procedures designed to identify and prevent abuse and neglect. Provides that the surveillance procedures must include, but not be limited to, the use of security cameras and the use of persons to perform covert investigations of the daily operation of the facility.

Senate Committee Amendment No. 1
Deletes everything after the enacting clause. Amends the Mental Health and Developmental Disabilities Administrative Act. Makes a technical change to a Section concerning site visits and inspections.

Deletes everything after the enacting clause. Amends the Mental Health and Developmental Disabilities Administrative Act. Provides that the Department of Human Services shall establish a system of regular and ongoing (now annual) on-site inspections, including unannounced visits, of each facility in its jurisdiction. Provides that the inspections shall be conducted to identify and prevent abuse and neglect (in addition to the other existing objectives of inspections). Provides that the Department shall study current and potential uses of closed circuit television monitoring and recording within certain institutions for the purpose of preventing and identifying abuse and neglect, and shall report to the General Assembly on the findings of the study.

House Amendment No. 1
Provides that the Department of Human Services shall establish a system of regular and ongoing on-site inspections "that shall occur at least annually" of each facility under its jurisdiction (instead of "including unannounced visits"). Provides that the Department shall study the current and potential uses of electronic monitoring (instead of closed circuit television monitoring) for specified purposes within State-operated developmental centers and developmental disabilities services programs funded, certified, or licensed by the Department of Human Services (instead of within institutions supervised or operated by the Department). Provides that the Department shall report to the General Assembly on the feasibility of increasing utilization of electronic monitoring (instead of closed circuit television monitoring).
