Amends the Code of Criminal Procedure of 1963. Makes a technical change in a Section concerning preservation of evidence for forensic testing.

Replaces everything after the enacting clause. Amends the Code of Criminal Procedure of 1963. Provides that the defendant may make a motion for performance of Integrated Ballistic Identification System or forensic DNA testing on evidence: (1) that was not the subject of testing which is now requested at the time of trial (rather than because the technology for the testing was not available at the time of trial) or (2) although previously subjected to testing, can be subjected to additional testing utilizing a method that was not scientifically available at the time of trial that provides a reasonable likelihood of more probative results. Reasonable notice of the motion shall be served upon the State. Provides that if evidence previously tested reveals an unknown fingerprint from the crime scene that does not match the defendant or the victim, the order of the Court shall direct the prosecuting authority to request the Illinois State Police Bureau of Forensic Science to submit the unknown fingerprint evidence into the FBI's Integrated Automated Fingerprint Identification System (AIFIS) for identification. Effective immediately.

Amends the Illinois Criminal Justice Information Act. Provides that subject to appropriation, a Capital Crimes Database shall be created within the Illinois Criminal Justice Information Authority (ICJIA). Provides that the ICJIA shall collect and retain in the Capital Crimes Database all information on the prosecution, pendency, and disposition of capital and capital eligible cases in Illinois. Provides that the Capital Crimes Database shall serve as a repository for all of the foregoing collected information. Amends the Illinois Police Training Act. Provides that subject to appropriation, the Illinois Law Enforcement Training Standards Board shall develop technical guidelines for the mandated recording of custodial interrogations in all homicide investigations by law enforcement agencies. Provides that these guidelines shall be developed in conjunction with law enforcement agencies and technology accreditation groups to provide guidance for law enforcement agencies in implementing the mandated recording of custodial interrogations in all homicide investigations. Amends the Criminal Code of 1961. Provides that the offense of armed violence does not include the following offenses committed while armed with a dangerous weapon: second degree murder, involuntary manslaughter, reckless homicide, or any offense that makes the possession or use of a dangerous weapon either an element of the base offense, an aggravated or enhanced version of the offense, or a mandatory sentencing factor that increases the sentencing range.
