Amends the Genetic Information Privacy Act. Makes a technical change in a Section concerning legislative intent.

Replaces everything after the enacting clause. Amends the Firearm Owners Identification Card Act. Provides that the Department of State Police and the Department of Human Services shall, in accordance with State and federal law regarding confidentiality, enter into a memorandum of understanding with the Federal Bureau of Investigation for the purpose of implementing the National Instant Criminal Background Check System in the State. Provides that the Department of State Police shall report the name, date of birth, and physical description of any person prohibited from possessing a firearm pursuant to the Firearm Owners Identification Card Act and certain provisions of the federal Gun Control Act to the National Instant Criminal Background Check System Index, Denied Persons Files. Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that public hospitals and mental health facilities shall furnish to the Department of State Police such information as may be required for the sole purpose of determining whether an individual is disqualified from receiving or retaining a Firearm Owner's Identification Card. Defines "mental health facility".

House Amendment No. 1
Makes technical and grammatical changes. In the amendatory changes to the Mental Health and Developmental Disabilities Confidentiality Act, provides that mental health records may be redisclosed for checking with the National Instant Criminal Background Check System Index to determine if a person is prohibited from obtaining a firearm under federal or State law. Provides that the definition of mental health facility is as defined in the Mental Health and Developmental Disabilities Code. Changes definition of "patient".

 SB 940 (H-AM 1) has no fiscal impact to the Department of Human Services.

 Passage of this legislation will cause no fiscal impact to the Illinois Department of Transportation.

 This legislation would neither increase nor decrease the number of judges needed in the judicial branch.

 Fiscal Note, House Amendment No. 1 (Illinois State Police)
 If SB 940 (H-AM 1) were to become law, the fiscal impact to the Illinois State Police would be approximately $100,000.
