Synopsis As Introduced
Amends the Public Utilities Act. Provides that the Illinois Commerce Commission may authorize certain public utilities to impose a fire protection charge to meet the fire protection needs of customers (now, the fire protection needs of any municipality or public fire protection district is covered). Provides that any fire protection charge imposed shall reflect the costs associated with providing fire protection service as determined by the Commission for each service area of the public utility for which the Commission determines a separate revenue requirement. Effective immediately.

House Amendment No. 2

Adds language providing that a water or sewer utility that receives notice that a fire hydrant is broken shall be required to report the situation to the fire department or fire district within 2 hours of receiving notice, and shall be required to make repairs within 2 days. Provides that a water or sewer utility that fails to notify the fire department or fire district within 2 hours after receiving notice that a fire hydrant is broken shall be fined $500 per day to be paid to the fire department or fire district. Provides that the penalty may be waived if approved by the fire department or the fire district if a delay in the repair is unavoidable. Provides that a water or sewer utility must report the conditions of fire hydrants to the unit of local government on an annual basis.

Replaces everything after the enacting clause. Amends the Railroad Police Act. Provides that the Illinois Law Enforcement Training Standards Board shall review the policies and guidelines of a railroad carrier concerning its railroad police force and approve them if they comply with the Act. Provides that a person adversely affected by a decision of a rail carrier's internal investigation under the Act may appeal to the Illinois State Police no later than 90 days after the decision. Provides that the State Police shall review the depth, completeness, and objectivity of the carrier's investigation and may conduct its own investigation. Provides that the State Police may uphold, overturn, or modify the decision by filing a report of its findings and recommendations with the Illinois Commerce Commission. Provides that the Commission shall have the power to conduct evidentiary hearings and issue and enforce orders, including sanctions. Imposes conditions on any rulemaking authority.
