Statutes Amended In Order of Appearance
225 ILCS 335/6from Ch. 111, par. 7506

Synopsis As Introduced
Amends the Illinois Roofing Industry Licensing Act. Provides that the expiration date and renewal period for each certificate of registration issued under the Act shall be set by the Department by rule (now, licenses shall expire biennially at midnight on June 30 of each odd-numbered year). Provides that a licensee whose license has expired or is on inactive status may have his or her license restored by making application to the Department in the form and manner prescribed by the Department (now, failure to renew the license before it expires shall cause the license to become nonrenewed and it shall be unlawful thereafter for the licensee to engage, offer to engage, or hold himself or herself out as engaging, in roofing contracting business under the license unless and until the license is restored or reissued as defined by rule).

Deletes everything after the enacting clause. Reinserts the contents of the bill as introduced with the following changes. Further amends the Illinois Roofing Industry Licensing Act. Makes changes in the definition of "roofing contractor". Provides that applications for licensure as a legal entity submitted by currently licensed sole proprietors or legal entities shall, upon meeting certain requirements, not be considered applications for initial licensure that are subject to the examination requirement and that, upon issuance of the new license, the former license is terminated. Makes changes in a Section concerning grounds for disciplinary action, including allowing the Department of Financial and Professional Regulation to impose fines not to exceed $10,000 (instead of $1,000) for each violation of the Act. Removes a provision that allows the Department to issue a rule to show cause why an order to cease and desist should not be entered against a person engaged in the unlicensed practice of roofing and sets forth a provision allowing the Department to issue an order to cease and desist such unlicensed practice without a hearing.
