Synopsis As Introduced
Amends the Private Sewage Disposal Licensing Act. Defines "off-lot discharging private sewage disposal system". Provides that every owner of an off-lot discharging private sewage disposal system must file a "Notice of Intent" with the Department of Public Health to allow coverage of the system under the blanket National Pollutant Discharge Elimination System (NPDES) permit of the State. Effective immediately.

Deletes everything after the enacting clause. Amends the Private Sewage Disposal Licensing Act. Provides that every owner of a discharging private sewage disposal system must provide satisfactory proof to the Department of the filing of a "Notice of Intent" with the Environmental Protection Agency, unless the private sewage disposal system does not enter the navigable waters of the State or surface waters that are tributary to navigable waters of the State. Amends the Environmental Protection Act. Provides that every owner of a discharging private sewage disposal system that enters the navigable waters of the State or surface waters that are tributary to navigable waters of the State must file a "Notice of Intent" with the Agency to allow coverage of the system under the blanket NPDES permit of the State. Effective immediately.

Deletes everything after the enacting clause. Amends the Private Sewage Disposal Licensing Act. Defines "NPDES" and "surface discharging private sewage disposal system". Provides that a surface discharging private sewage disposal system installed on or after January 1, 2008 must file a Notice of Intent with the Agency to allow coverage of the system under the State's blanket NPDES permit. Sets out specific fee, maintenance, and compliance requirements for those sewage disposal systems. Amends the Environmental Protection Act to make corresponding changes. Defines "surface discharging private sewage disposal system". Effective immediately.

 Fiscal Note, House Amendment No. 2 (Illinois Environmental Protection Agency)
 Passage of SB 184 (H-AM 2) could result in the USEPA's revoking the Illinois EPA's delegation agreement, thereby causing a loss of $4 million per year to the Illinois EPA.
