Synopsis As Introduced
Amends the Regulatory Sunset Act to change the repeal date of the Clinical Social Work and Social Work Practice Act from January 1, 2008 to January 1, 2018. Amends the Clinical Social Work and Social Work Practice Act. Replaces "Department of Professional Regulation" with "Department of Financial and Professional Regulation" and "Director of the Department of Professional Regulation" with "Secretary of Financial and Professional Regulation" throughout the Act. Adds a provision concerning an applicant's or licensee's change of address. Provides that a civil penalty of $10,000 (rather than $5,000) shall be imposed upon an individual for each offense of unlicensed practice. Makes changes to provisions concerning licensure, licensure by endorsement, grounds for disciplinary action, rehearing, and the appointment of a hearing officer. Makes other changes. Effective immediately.

Senate Floor Amendment No. 2
Deletes everything after the enacting clause. Reinserts the provisions of the bill as introduced with the following changes. Makes changes to various definitions. Requires the records related to the maintenance of licensee rosters to be kept for a minimum of 5 years. Provides that one member of the Social Work Examining and Disciplinary Board shall be employed in a public human service agency. Provides that the Social Work Examining and Disciplinary Board shall include one member of the public who is not regulated under the Clinical Social Work and Social Work Practice Act or a similar Act and who represents consumer interests. Requires the Department of Financial and Professional Regulation to adopt rules establishing minimum requirements of continuing education and means for verification of the completion of those requirements, and allows the Department to specify, by rule, circumstances under which the continuing education requirements may be waived (instead of providing that continuing education requirements are as defined by rule). Provides that the Department may refuse to issue or renew or may suspend the license of a person who has failed to pay any court-ordered child support. Makes other changes. Effective immediately.

House Amendment No. 1
In the Section of the Clinical Social Work and Social Work Practice Act concerning the appointment of a hearing officer, sets forth a procedure for direct appeal by the respondent if the Social Work Examining and Disciplinary Board does not present its findings of fact, conclusions of law, and recommendations to the Secretary of Financial and Professional Regulation within a certain time period after receipt of the hearing officer's report, and provides for the adoption of the hearing officer's report as a final decision of the Secretary upon the Secretary's failure to issue an order within 30 days after the Board's failure to report.

Amends the Carnival and Amusement Rides Safety Act, if and only if House Bill 820 becomes law. Provides that provisions concerning the employment of carnival workers apply to persons, firms, corporations, and other entities that own or operate a fair. Makes changes to provisions concerning civil penalties imposed for violations of carnival worker employment requirements, including changes in the maximum amount of penalties. Provides that a carnival or fair owner is not responsible for (i) any personal information submitted by a carnival worker for criminal history records check purposes or (ii) any information provided by a third party for a criminal history records check or a sex offender registry check, and shall not be liable to any employee in carrying out the carnival worker employment requirements. Makes other changes.
