Synopsis As Introduced
Amends the Adoption Act. Provides that individual health information summaries concerning the child and each birth parent shall be filed within 14 days of the petition filing in all adoptions of unrelated minors. Provides that each preadoption investigation shall review the health summaries. Provides that health summaries shall be without any information identifying either birth parent and shall summarize significant medical, dental, and mental health information including diseases, disabilities, alcohol or drug abuse, hereditary conditions or diseases, and drugs or medications used by the birth mother during the child's pregnancy. Provides that adoptive parents or the adopted child when he or she is an adult may petition the court for the release of the summaries. Provides that no liability shall attach to anyone who provides information for a health summary or to the adoption registry (at present, liability protections only apply to the adoption registry). Provides that all information in health summaries is confidential and is not to be used as evidence in any other proceeding. Effective immediately.

Replaces everything after the enacting clause with substantially similar provisions, except for the following: (1) provides that the individual health information summary requirements do not apply to a related adoption, an adoption assisted by an Illinois child welfare agency, or an intercountry adoption (instead of any adoption); (2) provides that the summaries shall be filed with the Illinois Adoption Registry (instead of the circuit court clerk) along with a certified copy of the adoption petition; and (3) provides that individual health information summaries from the birth father and birth mother shall include the person's age (instead of age and general physical characteristics). Effective immediately.

Deletes everything after the enacting clause. Amends the Children and Family Services Act. Deletes a provision that certain financial assistance and educational assistance grants by the Department of Children and Family Services are subject to federal financial participation in the cost. Amends the Adoption Act. Provides that if an adoptive parent dies before a final adoption judgment is entered and the other adoptive parent petitions to proceed, the court shall proceed to hearing and final judgment (instead of proceed to hearing and final judgment to enable the child to have the intended name by adoption). Effective immediately.
