Synopsis As Introduced
Amends the Automatic Telephone Dialers Act. Requires all autodialers operated within the State to immediately (instead of within 30 seconds) disconnect after termination of the call by the subscriber or the autodialer or, if immediate disconnection is not possible, to use a live operator. Requires an autodialer to provide the complete company name, address, and return phone number within its pre-recorded message. Requires an autodialer to be properly registered so that the name and telephone number displays on any caller ID. Provides that an autodialer shall provide within the pre-recorded message an option of pressing a designated button to connect with a live operator at any time during the message. Effective January 1, 2008.

House Amendment No. 1
Adds reference to:
815 ILCS 305/20from Ch. 134, par. 120

Restores existing language requiring disconnection of autodialers within 30 seconds (rather than immediately) after termination of the call. Deletes language requiring the autodialer to provide the company address within its pre-recorded message. Provides that the autodialer's name or telephone number or both must be available for display for caller ID (rather than providing that the autodialer's name and telephone number must display on any caller ID). Provides that, as an alternative to providing the option of connecting to a live operator, the pre-recorded message may provide a phone number for opting out of further solicitation calls. Adds public policy organizations to the list of organizations exempt from the provisions regarding autodialing calls in the Act.
