Synopsis As Introduced
Creates the Illinois Stem Cell Initiative of 2007. Contains only a short title provision.

Senate Committee Amendment No. 1
Deletes everything after the enacting clause. Creates the Stem Cell Research and Human Cloning Prohibition Act. Permits research involving the derivation and use of human embryonic stem cells, human embryonic germ cells, and human adult stem cells from any source, including somatic cell nuclear transplantation, and allows public funding for stem cell research programs. Requires the Department of Public Health to develop and administer the Illinois Regenerative Medicine Institute program to provide for the awarding of grants to Illinois medical research institutions. Creates the Illinois Regenerative Medicine Institute Oversight Committee. Provides that a Committee member with a conflict of interest shall not vote upon or participate in any Committee action with respect to that matter. Requires each Committee member to file disclosures with the Secretary of State. Prohibits cloning or attempts to clone a human being. Prohibits the purchase or sale of embryonic or cadaveric fetal tissue for research purposes. Makes the purchase or sale of embryonic or cadaveric fetal tissue for research a Class A misdemeanor for the first conviction and a Class 4 felony for subsequent convictions.

Senate Floor Amendment No. 4
Provides that all Illinois Regenerative Medicine Institute information concerning medical research shall be confidential and privileged and not subject to disclosure to any person other than Institute personnel. Provides that a member of a scientific peer review panel or any other advisory committee that may be established by the Department of Public Health who has a conflict of interest with respect to a matter may not discuss that matter with other peer review panel or advisory committee members or with Committee members and shall not vote or otherwise participate in any peer review panel or advisory committee action with respect to that matter. Provides that each recusal of a peer review panel or advisory committee member occurring during a peer review panel or advisory committee meeting shall be made a part of the minutes or recording of the meeting in accordance with the Open Meetings Act. Provides that each member of a scientific peer review panel and any advisory committee member shall also file income and interest disclosure statements with the Secretary of State. Provides that a person who clones or attempts to clone a human being is guilty of a Class 4 felony (rather than a Class A misdemeanor) for a first conviction and a Class 1 (rather than a Class 4) felony for subsequent convictions.

Senate Floor Amendment No. 5
Makes all violations of the cloning prohibition a Class 1 felony.

 Housing Affordability Impact Note (Housing Development Authority)
 This legislation will have no effect on constructing, purchasing, owning, or selling a single-family residence.

 State Debt Impact Note (Dept. of Commerce & Economic Opportunity)
 SB 4, as engrossed will not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

Balanced Budget Note (Governor's Office of Mgmt & Budget)
The cost of SB 4 is $258,233 per year, which is the annual cost of 3 additional headcount for the Department of Public Health. This bill, if enacted into law, will lead to an unbalanced proposed Fiscal Year 2008 budget.

 Fiscal Note (Dept. of Public Health)
 It is estimated that implementation of HB 138 would require three additional headcount at an annual cost of $258,233. There is a companion bill, HB 139, that allocates $25 million of tobacco settlement money to fund the Illinois Regenerative Medicine Institute for FY 2008.
