Synopsis As Introduced
Amends the Toll Highway Act. Provides that the Illinois State Toll Highway Authority must send a toll violation notice to the registered owner of a vehicle at the address on the plate registration if the owner has accrued 3 or more toll violations. Provides that, if the Authority fails to notify the owner, the Authority may not charge penalties on the fine and must allow the individual to participate in a payment plan. Provides that the Authority must notify users of its electronic toll collection system who pay cash when the balance in the user's account is less than $10.

House Amendment No. 1
Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.

 Fiscal Note, House Amendment No. 1 (Illinois State Toll Highway Authority)
 The Tollway currently notifies patrons voluntarily through three methods. The methods include daily emails to low balance accounts, weekly automatic calls to accounts with negative balances, and periodic mailings to accounts with negative balances. Assuming that "users of the electronic tolling system that pay with cash" excludes those users that utilize credit card auto replenishment, the Tollway estimates it would incur about $900 thousand of costs annually to provide additional notice to user with low balances. Those costs include software application development, call center processing, postage, printing, and additional staff. The additional cost to notify all users, including those that utilize auto replenishment, would be approximately $3 million.
