Synopsis As Introduced
Amends the Downstate Police Article of the Illinois Pension Code. Allows payment of a survivor's pension to the surviving spouse and children of a marriage occurring after retirement, if the surviving spouse and the deceased police officer were married for at least one year immediately preceding the date of death. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

 The fiscal impact for HB 5158 is yet to be determined as it is unknown how many participants will be eligible to receive benefits.

 The Commission’s actuary has performed a cost study of HB 5158 under the assumption that the percentage of retired police officers who would have a surviving spouse eligible to receive a survivor’s pension would increase from 80% to 85%. Based on the above assumption, the estimated costs involved with the proposed change for all Downstate police pension funds would be as follows: Increase in total actuarial liability = $61,453,000; Increase in total annual costs = 5,943,000; Increase in total annual costs as a percent of payroll = 0.77%.
