Synopsis As Introduced
Amends the Illinois Vehicle Code. Removes a uniform invoice from the list of records that a scrap processor may receive as documentary proof of ownership of the vehicle, junk vehicle, or vehicle cowl. Requires a scrap processor to record the name, address, and driver's license number of the person from whom a vehicle is received. Effective immediately.

Replaces everything after the enacting clause. Amends the Illinois Vehicle Code. Prohibits a recyclable metal dealer from acquiring or possessing a vehicle, junk vehicle, vehicle cowl, or essential vehicle parts for the purpose of processing it into a form other than a vehicle, unless that recyclable metal dealer is also licensed by the Secretary of State as a scrap processor pursuant to the Code. Changes the list of documents that a scrap metal processor or recyclable metal dealer may accept for proof under the record keeping requirements. Provides that any scrap processor or recyclable metal dealer who finds a nonconforming vehicle identification number on any documentary proof of ownership of a vehicle, junk vehicle, or vehicle cowl provided by the person attempting to dispose of such item shall report the offense to the Secretary of State, including the name of the person attempting to dispose of the vehicle, junk vehicle, or vehicle cowl, the actual vehicle identification number, the nonconforming vehicle number, the vehicle license plate number, a copy of the document used, and the license number of the person or persons involved in the attempted transaction. Provides that any person licensed as a scrap processor who is found to be in violation of the reporting requirements or any licensed entity found in violation of these provisions shall be subject to suspension of his or her license for a period of up to 5 years. Provides that any person in violation of the reporting requirements shall be guilty of a Class 2 felony. Provides that scrap processors and recyclable metal dealers shall, under no circumstances, be permitted to use the Uniform Invoice for any purpose under the provisions of the Code concerning dealers, transporters, wreckers, and rebuilders. Makes other changes.

House Amendment No. 4
Restores language providing that a certificate of title may be used as proof of ownership of a vehicle in certain transactions. In connection with a provision that a scrap processor or recyclable metal dealer shall verify and record the identity of the person from whom recyclable metals valued at $100 or more were acquired by recording the identification of that person from a driver's license or State Identification Card on the weight ticket at the time of the acquisition, deletes amendatory language stating that the provision does not apply to purchases of vehicles or vehicle essential parts. Provides that a licensee or recyclable metal dealer who knowingly fails to record any of the specific information required to be recorded on the weight ticket or who knowingly fails to acquire and maintain documentary proof of ownership is subject to suspension of his or her license for a period of up to 5 years (rather than a period of 5 years). Provides that a violation of the provision prohibiting use of the Uniform Invoice is a Class 2 felony. Makes other changes.
