Synopsis As Introduced
Amends the State Finance Act, the Roadside Memorial Act, and the Unified Code of Corrections. Provides that a person who is convicted or receives a disposition of court supervision for a violation of certain DUI provisions of the Illinois Vehicle Code shall, in addition to any other disposition, penalty, or fine imposed, pay a fee of $50 which shall be deposited into the Roadside Memorial Fund. Creates the Roadside Memorial Fund as a special fund in the State treasury. Provides that, subject to appropriation, all moneys in the Roadside Memorial Fund shall be used by the Department of Transportation to pay fees for DUI memorial markers under the Roadside Memorial Act.

 According to the Secretary of State's Office, in 2007 (the latest data available) there were just over 50,000 arrests for DUI, of which 95% resulted in either convictions or court supervision. If each one of these 47,500 cases were assessed the $50 fine proposed by this bill, that would generate $2,375,000 per year. Under the current provisions of the Roadside Memorial Act, markers are placed only be request of the family of the deceased and they are charged for the cost of placing the marker. Although this bill would increase spending by the Department, those payments would not exceed the revenues from this new source and, more importantly, would relieve the families of some, or all, of the burden of having memorial markers placed. It should also be noted that these payments would not come at the expense of other highway program resources. These changes would require a corresponding appropriation to the Department from the new Roadside Memorial Fund.

Amends the State Finance Act. Provides that provisions allowing the transfer of sums from certain special funds into the General Revenue Fund do not apply to the Roadside Memorial Fund.
