Synopsis As Introduced
Amends the Criminal Code of 1961. Provides that it is a Class 4 felony for a person required to register as a sex offender under the Sex Offender Registration Act to access or use a social networking website during the period for which the sex offender is required to register under that Act. Amends the Unified Code of Corrections. Requires as condition of parole, mandatory supervised release, probation, conditional discharge, or supervision that a sex offender refrain from accessing or using a social networking website during the period for which the sex offender is required to register under the Sex Offender Registration Act.

House Amendment No. 1
Provides that telecommunications carriers, commercial mobile service providers, and providers of information services, including, but not limited to, Internet service providers and hosting service providers, are not liable by virtue of the transmission, storage, or caching of electronic communications or messages of others or by virtue of the provision of other related telecommunications, commercial mobile services, or information services used by others in violation of the provisions of the bill prohibiting the use of social networking websites by sex offenders.

Deletes reference to:
720 ILCS 5/16D-5.5 new

Deletes new provision that makes it a Class 4 felony for a person required to register as a sex offender under the Sex Offender Registration Act to access or use a social networking website during his or her registration period. Deletes provisions that the offender's condition of mandatory supervised release, probation, or supervision that prohibits the offender from accessing or using a social networking website, extends throughout the period for which the sex offender is required to register under the Sex Offender Registration Act.
