Synopsis As Introduced
Amends the Environmental Protection Act. In a Section defining "coal combustion by-product" (CCB), provides that coal combustion waste must be covered with 12 inches of soil, within 30 days after deposit of the coal combustion waste, before it may be considered as CCB. Provides that coal combustion waste may be used as CCB only if the structural fill is located no less than 500 feet from any residence and any well being used as a residential water source. Provides for the inspection of structural fill CCB projects by the Environmental Protection Agency. Provides that the Agency must adopt rules concerning the use of coal combustion waste and sets out requirements for those rules. Provides a cause of action for persons harmed by the violation of that provision.

House Amendment No. 1
Deletes everything after the enacting clause. Reinserts the provisions of the introduced bill with the following changes: Makes changes to the criteria for using CCB as structural fill. Requires the Governor, in coordination with the Environmental Protection Agency and Pollution Control Board, to propose rules to the General Assembly concerning the specific guidelines for the use of CCB as structural fill and for a site-approval process (instead of requiring the Agency to adopt the rules). Makes other changes.

House Amendment No. 3
Provides that there is no rulemaking authority under the amendatory Act, but that the Governor shall propose rules by January 1, 2009 to the General Assembly. Sets forth the requirements for the proposed rules.
