Synopsis As Introduced
Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Requires the Secretary of Financial and Professional Regulation to appoint within the Division of Professional Regulation a Condo Oversight Officer to (i) receive complaints from condominium owners and create and maintain an electronic database of those complaints, accessible and searchable by the public, (ii) receive and investigate complaints from condominium boards, and (iii) report annually to the General Assembly, Governor, and Attorney General on recommendations for changes in condominium law. Effective immediately.

 Fiscal Note (Financial & Professional Regulation)
 HB 3461 has a $300,000* fiscal impact to the Illinois Department of Financial and Professional Regulation. HB 3461 requires the development and then the subsequent annual maintenance of the database system. Duties related to the outlined in the proposed legislation will be absorbed by current on-board staff. This amount is based on the Department's standard cost for an outside source to design and develop the database application. (*After the initial year the database would require an additional $50,000.00 for annual maintenance.)

 Fiscal Note (Financial & Professional Regulation)
 HB 3461 has an $859,753.00 FY08 fiscal impact to the Illinois Department of Financial and Professional Regulation. This legislation requires the hiring of six staff members as follows: Condo Oversight Officer (PSA), Administrative Assistant II, Complaint In-take Person (Office Associate) and three investigators, to perform duties outlined in the proposed legislation. The costs are based on an annualized amount for FY 08: (1) Personal Services and Related = $467,153.00; (2) Other Operations = $392,600.00; Total Fiscal Impact = $859,753.00.
