Deletes everything after the enacting clause. Amends the Airport Authorities Act. Provides that the Board of Commissioners of an airport authority in a county with a population between 200,000 and 500,000 may establish a Rail Authority. Provides that the Rail Authority shall be governed by a Board of Directors consisting of the Board of Commissioners of the airport authority and certain other members. Allows the airport authority to issue bonds for the benefit of the Rail Authority. Sets forth the powers of the Rail Authority, including the power to provide freight and passenger rail service, the power to set fares, the power to issue bonds, and the power to establish a separate public corporation. Provides that the Rail Authority shall not have the power of eminent domain. Makes other changes. Effective immediately.

House Amendment No. 2
Provides that the power of the Rail Authority to contract with rail service providers is subject to the approval of the Bureau of Railroads of the Illinois Department of Transportation.

House Amendment No. 3
Deletes reference to:
70 ILCS 5/22.5 new

Deletes everything after the enacting clause. Reinserts the substantive provisions of House Amendment 1 with changes. Removes language that exempts the Rail Authority from the Public Utilities Act. Removes language that permits the Rail Authority to establish a separate public corporation. Provides that the Authority is not a rail carrier. Provides that the Authority may enter into agreements with non-rail transportation service providers (instead of rail and other transportation service providers). Makes other changes. Effective immediately.
