Synopsis As Introduced
Amends the Public Utilities Act. Makes a technical change in a Section concerning the reading of meters.

House Amendment No. 1

Replaces everything after the enacting clause. Amends the Electric Service Customer Choice and Rate Relief Law of 1997 in the Public Utilities Act. Provides that the Illinois Commerce Commission shall implement and maintain a consumer education program for energy conservation to provide residential and small commercial retail customers with information to help them understand their options concerning energy conservation. Provides for a working group for implementation of provisions. Provides that by January 1, 2008, educational materials for small commercial customers and residential customers, the working group shall develop a package of printed educational materials and shall submit such package to the Commission for approval, along with recommendations for implementing the program. Provides that the costs of printing educational materials approved by the Commission pursuant to the provisions shall be payable solely from funding appropriated each year to the Commission from the General Revenue Fund for the expenses of the Commission associated with the program. Provides that the Commission shall study the effectiveness of the consumer education program for energy conservation. Effective immediately.

Replaces everything after the enacting clause. Amends the Illinois Mortgage Foreclosure Law in the Code of Civil Procedure. Provides that except in the circumstance in which a mortgagor has filed a petition for relief under the United States Bankruptcy Code, no mortgagee shall file a complaint to foreclose a mortgage secured by residential real estate until the mortgagee has satisfied specified requirements. Contains provisions concerning the requirements and procedures for notification of delinquency for a mortgage. Specifies procedures against a mortgagor concerning legal action under specified provisions. Specifies the liabilities of counselors concerning counseling for home loans. Contains provisions concerning the reporting of information to consumer reporting agencies. Specifies the powers and duties of the Secretary of Financial and Professional Regulation concerning certain provisions. Provides that there shall be no waiver of these provisions. Provides that it is the General Assembly's intent that compliance with these provisions shall not prejudice a mortgagee in ratings of its bad debt collection or calculation standards or policies. Provides that these provisions are repealed 2 years after the effective date of the amendatory Act. Contains a severability clause. Imposes conditions on any rulemaking authority. Effective immediately.
