Replaces everything after the enacting clause. Amends the Illinois Horse Racing Act of 1975 and the Riverboat Gambling Act. Extends the period until which owners licensees must pay into the Horse Racing Equity Trust Fund an amount equal to 3% of the adjusted gross receipts to (i) June 30, 2011, (ii) the date any organization licensee begins to operate a slot machine or video game of chance, or (iii) the wagering tax is increased by law to reflect a tax rate that is at least as stringent or more stringent than the tax rate contained in specified provisions of the Riverboat Gambling Act, whichever occurs first. Provides that the payment of 15% of the adjusted gross receipts of specified owners licensees from the State Gaming Fund to the Horse Racing Equity Fund shall begin June 30, 2011, unless any organization licensee under the Illinois Horse Racing Act of 1975 begins to operate a slot machine or video game of chance under the Illinois Horse Racing Act of 1975 or the Riverboat Gambling Act. Effective immediately.

Senate Committee Amendment No. 1
Removes language providing that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.

Senate Committee Amendment No. 2
Adds the date that certain payments to the Horse Racing Equity Fund from the State Gaming Fund begin to the criteria which would terminate the impact fee. Provides that the payment of 15% of the adjusted gross receipts of specified owners licensees from the State Gaming Fund to the Horse Racing Equity Fund shall begin on the effective date of this amendatory Act, unless any organization licensee under the Illinois Horse Racing Act of 1975 begins to operate a slot machine or video game of chance under the Illinois Horse Racing Act of 1975 or the Riverboat Gambling Act.

Creates the Chicago Casino Development Authority Act and the Illinois Casino Development Authority Act to create authorities for the purposes of developing and operating casinos. Amends the Illinois Horse Racing Act of 1975. Makes changes concerning the Illinois Racing Board. Allows advance deposit wagering. Adds provisions concerning drug testing for horses. Makes other changes. Amends the Illinois Horse Racing Act of 1975 and the Riverboat Gambling Act to provide for the conduct of electronic gaming at tracks. Makes other changes. Amends the Riverboat Gambling Act. Makes changes concerning the Illinois Gaming Board. Authorizes the issuance of an additional riverboat license and 2 casino licenses. Contains provisions regarding the re-issuance of the 10th riverboat license. Allows the Chicago Casino Development Authority and the Illinois Casino Development Authority to receive casino licenses. Changes the short title to the Illinois Gambling Act and makes corresponding changes in other Acts. Provides for the conduct of electronic poker. Amends the Retailers' Occupation Tax Act with respect to the State sales tax collected on motor fuel. Amends the School Construction Law to create the Chicago Public Schools Capital Needs Board. Makes other changes. Effective immediately.

Senate Floor Amendment No. 4
In provisions amending the Department of Transportation Law of the Civil Administrative Code of Illinois, provides that the Auditor General shall verify the accuracy of the Department's reporting related to the Condition Rating Survey mandates with an audit every 2 years. In provisions amending the State Finance Act, makes changes concerning distributions from the FOCUS Fund and adds various funds to the provisions prohibiting the Governor from making transfers to the General Revenue Fund. In provisions amending the Retailers' Occupation Tax Act, provides for moneys to be paid into the Illinois Works Debt Service Fund rather than into the Illinois Works Fund. In provisions amending the Illinois Horse Racing Act of 1975, makes changes concerning simulcast programs. In provisions amending the Riverboat Gambling Act (now the Illinois Gambling Act), (i) provides that the additional riverboat license authorizes the conduct of gambling in a municipality that is economically depressed or that is sited in an economically depressed primary census statistical area, or both; however, the licensee must not conduct gambling pursuant to this license within 15 miles from a licensed riverboat in operation on the effective date of the amendatory Act, and requires that, in determining the water upon which the riverboat authorized by the additional license will operate, the Illinois Gaming Board shall minimize the reduction in privilege tax revenue received by the State as a result of the impact of the additional license on adjusted gross receipts generated by riverboat gambling conducted by licenses in effect on the date of the amendatory Act, (ii) requires the Illinois Gaming Board to give favorable consideration to certain factors in granting the additional license (otherwise, it is discretionary), (iii) changes the initial fees per position for additional positions on riverboats and electronic gaming positions from $50,000 per position to $40,000 per position, (iv) provides that moneys in the special account in the Illinois Works Fund shall be transferred monthly to the Illinois Education Trust Fund, (v) provides that 30% of the moneys deposited into the Illinois Works Debt Service Fund shall be transferred into the Focusing on Children Uplifting Schools (FOCUS) Fund, and (vi) provides that annual fees for issuance or renewal of certain licenses shall not exceed $250,000 in any 4-year period.

Senate Floor Amendment No. 5
Provides that the bill takes effect upon becoming law, but only if and not until all of the following House Bills of the 95th General Assembly become law: 1496, 2651, 4723, 5618, and 6339.

Senate Floor Amendment No. 6
In provisions amending the Riverboat Gambling Act concerning the Nomination Panel, provides that selections for certain official positions by the Governor must receive the advice and consent of the Senate by record vote of at least two-thirds of the members elected (instead of just the consent of the Senate).
