Deletes everything after the enacting clause. Amends the Electric Service Customer Choice and Rate Relief Law of 1997 in the Public Utilities Act. Provides that no electric utility shall be allowed to engage in any labor displacement or reductions below the staffing levels for each job classification in existence on January 1, 2007, unless it meets specified criteria. Provides that the provisions shall not prevent a labor displacement or reduction due to attrition so long as the electric utility fills the vacancy or vacancies within a reasonable period of time, which in no case shall be greater than 6 months. Provides that the employees of an electric utility, including the collective bargaining representative or representatives of the employees, shall have an independent statutory cause of action under State law to file a complaint against an electric utility in circuit court for alleged violations of specified provisions. Provides that if an employee of an electric utility, including the collective bargaining representative or representatives of such employees, demonstrates that an electric utility has violated or is about to violate certain provisions, the circuit court shall permanently restrain or order the defendant or defendants from continuing the alleged violation and award the party bringing the action the reasonable expenses of the litigation, including all reasonable attorney's fees. Effective immediately.

Correctional Note, House Amendment No. 1 (Dept of Corrections)
Corrections Population Impact: None; Fiscal Impact: None; Fiscal Implications: None.

Fiscal Note, House Amendment No. 1 (Dept of Corrections)
Corrections Population Impact: None; Fiscal Impact: None; Fiscal Implications: None.

State Debt Impact Note, House Amendment No. 1 (Government Forecasting & Accountability)
HB 2071 (H-AM 1) would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

Pension Note, House Amendment No. 1 (Government Forecasting & Accountability)
HB 2071 (H-AM 1) will not impact any public pension fund or retirement system in Illinois.

Fiscal Note, House Amendment No. 1 (Illinois Commerce Commission)
The Commission estimates the need for an additional electrical engineer at an annual cost of $120,000.

Judicial Note, House Amendment No. 1 (Admin Office of the Illinois Courts)
This legislation may cause a minimal increase in judicial workloads. However, the bill would neither increase nor decrease the number of judges needed in the judicial branch.

Housing Affordability Impact Note, House Amendment No. 1 (Housing Development Authority)
This legislation will have no effect on constructing, purchasing, owning, or selling a single-family residence.

State Mandates Fiscal Note, House Amendment No. 1 (Dept. of Commerce & Economic Opportunity)
This legislation does not create a State mandate under the State Mandates Act.

Home Rule Note, House Amendment No. 1 (Dept. of Commerce & Economic Opportunity)
This legislation does pre-empt home rule authority.

Balanced Budget Note, House Amendment No. 1 (Gov Office of Mgmt & Budget)
HB 2071 (H-AM 1), if signed into law, will become effective immediately. This legislation will have zero to minimal impact to State revenues but will impact the operations of the Commission. The Commission does not currently have anyone with the expertise that this bill requires and would have to hire one new employee to cover these responsibilities. The salary and related benefits would cost approximately $120,000 and would lead to an unbalanced Fiscal Year 2008 budget.
