Synopsis As Introduced
Amends the Wrongful Death Act. Provides that the jury may award damages for grief, sorrow, and mental suffering to the surviving spouse and next of kin of the deceased. Provides that any amount reduced from a contributorily negligent beneficiary's share of damages shall be distributed to the other beneficiaries in proportion to their respective degrees of dependency. Deletes language regarding limitations on the amount of damages. Applies to causes of action accruing on or after the effective date of the amendatory Act. Effective immediately.

It is the opinion of the Department of Commerce and Economic Opportunity that this legislation does not create a State mandate under the State Mandates Act.

House Amendment No. 1
Replaces everything after the enacting clause with substantially similar provisions that: (1) provide that a jury in a wrongful death action may award damages for grief, sorrow, and mental suffering to the surviving spouse and next of kin of the deceased; (2) delete language regarding limitations on the amount of damages for deaths occurring in 1967 or before; and (3) provide that the change allowing for the award of damages for grief, sorrow, and mental suffering apply to causes of action accruing on or after the effective date. Effective immediately.
