Synopsis As Introduced
Amends the Rights of Crime Victims and Witnesses Act. Provides that "crime victim" includes both parents, legal guardians, and foster parents of a child killed as a result of a violent crime perpetrated against the child or both parents, legal guardians, and foster parents of a child victim who is physically or mentally incapable of exercising rights under the Act. Provides that the Act applies to proceedings under the Juvenile Court Act of 1987. Provides that a victim-witness specialist may be present at the court proceedings. Provides that support persons of the victim are subject to the admonition of the rules of confidentiality.

Senate Floor Amendment No. 2
Restores current law that defines crime victim to include a single representative who may be the spouse, parent, child or sibling of a person killed as a result of a violent crime perpetrated against the person killed or the spouse, parent, child or sibling of any person granted rights under the Act who is physically or mentally incapable of exercising such rights, except where the spouse, parent, child or sibling is also the defendant or prisoner (rather than both parents, legal guardians, foster parents, or a single adult representative). Provides that a crime victim for proceedings under the Juvenile Court Act of 1987 includes both parents, legal guardians, foster parents, or a single adult representative of a minor or disabled person who is a crime victim (rather than both parents of a deceased minor who is a crime victim).

Amends the Criminal Code of 1961. Provides that the penalty for reckless homicide in which the defendant was operating a vehicle while failing or refusing to comply with any lawful order or direction of any authorized police officer or traffic control aide engaged in traffic control is a Class 2 felony, for which a person, if sentenced to a term of imprisonment, shall be sentenced to a term of not less than 3 years and not more than 14 years if the defendant caused death of one person and a Class 2 felony, for which a person, if sentenced to a term of imprisonment, shall be sentenced to a term of not less than 6 years and not more than 28 years if the defendant caused death of 2 or more persons. Amends the Criminal Code of 1961. Provides that the assault of a person who is employed by a municipality and whose duties include traffic control is an aggravated assault. Provides that these provisions are effective immediately.
