Synopsis As Introduced
Amends the Elevator Safety and Regulation Act. Removes certain references to the design of elevators and related apparatuses. Provides that an applicant for an elevator mechanic's license who makes application by demonstrating to the Office of the State Fire Marshal acceptable proof that he or she has worked as an elevator constructor, maintenance, or repair person for the equipment that a licensee of the Act is authorized to install must make application to the Office by December 31, 2007 (rather than May 1, 2006), but that all licenses issued under those terms between May 1, 2006 and the effective date of the amendatory Act are deemed valid. Adds one representative of the senior citizen population who is appointed by the Governor to the Elevator Safety Review Board. Effective immediately.

 Fiscal Note (State Fire Marshal)
 Costs of implementation of the Elevator Safety Act and annual operations of the Division are still not fully understood, but are estimated to be achievable in FY08 with the proposed budget of $1 million. Likewise, receipts from initial registration and annual renewals cannot be based on in-state elevator records, but are estimated based on an initial compliance count of 25,000 which will result in approximately $4 million annually. The changes in HB 1423 will not materially affect these estimates: (1) The proposed change to Section 10 removes "design" by which additional costs of regulating design are avoided; (2) The proposed change to Section 25 adds a single member to the Elevator Board. This is an unpaid position with reimbursement of costs such as travel. The Board has not met regularly for a 12-month period, so estimation of costs is difficult. The total annual effect will not exceed $1,200; (3) The proposed change to Section 45 extends the deadline for licensure preventing a negative economic impact on the industry while having a zero to negligible effect on the agency by delaying revenue of approximately $250,000 for four months.

Deletes everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes. Further amends the Elevator Safety and Regulation Act. Makes changes to provisions concerning the applicability of the Act and certain definitions. Removes a provision concerning non-licensure under the Act. Requires the Elevator Safety Review Board to adopt the latest editions of certain professional standards within 6 months after the effective date of those standards. Provides that if the State, a unit of local government, or an institution of higher education maintains in its employ licensed or limited licensed elevator mechanics who maintain only conveyances owned or leased by that entity, then the employing entity is not required to be licensed as a contractor and the provisions of the Act concerning licensed contractors shall not apply to these entities. Exempts a licensed or limited licensed elevator mechanic employed by an entity exempted from contractor licensure, with respect to work performed for that employer, from the requirement that he or she work under the direct supervision of an elevator contractor licensee. Makes changes to the qualifications for an elevator mechanic's license and an elevator contractor's license. Allows the issuance of a permit to alter a conveyance to an entity exempted from contractor licensure. Requires elevator contractors and private elevator inspectors to provide general liability coverage of at least $1,000,000 for injury or death of any number of persons in any one occurrence, with at least $500,000 for property damage in any one occurrence (instead of $1,000,000 for injury or death of any one person and $2,000,000 for injury or death of any number of persons in any one occurrence, with coverage of at least $1,000,000 for property damage in any one occurrence). Provides that any owner or lessee who violates any provision of the Act is guilty of a Class C misdemeanor (instead of requiring the imposition of a fine in an amount not to exceed $1,500 per violation, per day). Allows the Office of the State Fire Marshal to extend the compliance dates set for conveyance owners found in violation of the Act for good cause, provided that such violations are minor and pose no threat to public safety. Makes other changes. Repeals a Section concerning accidents. Effective immediately.
