Synopsis As Introduced
Amends the Auction License Act. Provides that Internet auction storefronts are subject to the same laws and rules as auctioneers. Provides that a license that expires on September 30, 2009 shall instead expire on December 31, 2010, and thereafter a license shall expire every 2 years on December 31 of each even-numbered year. Provides that a renewal applicant for an auctioneer's (or associate's) license may complete continuing education courses in one day. Provides that a renewal applicant may receive credit in this State for similar continuing education courses in other states. Amends the Regulatory Sunset Act. Changes the scheduled repeal date on the Act to January 1, 2015 (from January 1, 2010).

Deletes everything after the enacting clause. Amends the Auction License Act. Replaces references to the Office of Banks and Real Estate with the Department of Financial and Professional Regulation, references to the Commissioner of the Office of Banks and Real Estate with the Secretary of Financial and Professional Regulation, and references to civil fines with civil penalties. Provides that license expiration dates, renewal periods, renewal fees, and procedures for renewal of licenses issued under the Act shall be set by rule of the Department (instead of a set expiration date of every 2 years beginning on September 30, 2001). Removes the continuing education verification requirement for renewal applications and makes other changes concerning continuing education requirements. Adds a provision concerning returned checks. Sets forth additional grounds for disciplinary action. Provides that any person who is found to have violated a provision of the Act is guilty of a Class A misdemeanor for the first offense and a Class 4 felony for the second and any subsequent offense. Provides that 5 members of the Auction Advisory Board shall be licensed auctioneers and that the Advisory Board shall annually elect one of its members to serve as Chairperson (instead of the Director of Auction Regulation serving as an ex officio member and Chairperson of the Advisory Board). Repeals a Section containing a grandfather clause, an Article concerning school and continuing education, and a Section requiring the appointment of a Director of Auction Regulation. Makes other changes.
