Synopsis As Introduced
Amends the Illinois Public Aid Code. Provides that in establishing eligibility standards in connection with Medicaid for persons with disabilities who are employed and eligible for Medicaid, the Department of Healthcare and Family Services shall (i) set the income eligibility standard at not lower than 350% of the federal poverty level, (ii) exempt the income of the person's spouse, the unearned income of the person's dependent child under the age of 18 years, and retirement accounts that the person cannot access without penalty until the age of 59 1/2, and (iii) allow non-exempt assets up to $25,000. Effective immediately.

 Fiscal Note (Dept. of Healthcare & Family Services)
 The cost to expand the current HBWD program is estimated at $1.3 million annually. Federal matching funds may be obtained after State Plan Amendments are submitted and approved.

 Fiscal Note (Dept. of Human Services)
 It is unknown how many individuals with disabilities, currently eligible for Social Security disability and not working would go to work if they could purchase Medicaid insurance if it was made available to them.

Senate Committee Amendment No. 1
Provides that the Department of Healthcare and Family Services' establishment of Medicaid eligibility standards for employed persons with disabilities is subject to federal approval. Deletes a requirement that the Department exempt the income of the person's spouse and the unearned income of the person's dependent child under age 18, and adds a requirement that the Department exempt medical savings accounts. Provides that the allowance of non-exempt assets up to $25,000 applies to those assets accumulated during periods of Medicaid eligibility under these provisions relating to employed persons with disabilities. Requires the Department to continue to apply the exemption of retirement accounts and medical savings accounts and the allowance of certain non-exempt assets in determining a person's eligibility for Medicaid even if the person loses eligibility on the basis of being an employed person with a disability.
