Synopsis As Introduced
Amends the Prevailing Wage Act. Provides that the Act applies to maintenance, repair, assembly, or disassembly work performed on equipment whether owned, leased, or rented. Provides that all contractors and subcontractors required to pay the prevailing wage shall make payment of the wage in legal tender without a deduction for food, sleeping accommodations, transportation, use of tools, or any other thing of any kind or description.

Replaces everything after the enacting clause. Reinserts the provisions of the bill with these changes: (1) deletes new provisions that "public works" includes any maintenance, repair, assembly, or disassembly work performed on equipment whether owned, leased, or rented; (2) provides that a public works project includes those financed in whole or in part with bonds issued under the Economic Development Area Tax Increment Allocation Act (rather than the Tax Increment Allocation Redevelopment Act) and changes reference from the Illinois Enterprise Zone Loan Act to the Illinois Enterprise Zone Act; and (3) provides that the public body or the Department of Labor shall make a revised prevailing rate of hourly wages available to the contractor and each subcontractor.

House Amendment No. 2
Replaces everything after the enacting clause. Reinserts the provisions of the bill as amended with these changes: (1) provides that various notifications must be written; (2) provides that the publication of the revised rate of prevailing wages on the Department of Labor's official website shall be deemed sufficient notice; (3) provides that beginning July 1, 2009, every public body awarding any contract for a public works or otherwise undertaking any public works shall notify the Department of Labor in writing, on a form and in a format prescribed by the Department of Labor, whenever a contract subject to the provisions of the Act has been awarded; (4) deletes various provisions relating to the imposition of penalties by the Director of Labor for violations of the Act; (5) provides that a whistle blower discharged, disciplined, or discriminated against may apply to the Director of Labor for review of the discharge, discipline, or discrimination within 60 (rather than 180) days after the alleged violation occurred; and (6) deletes provision that the site of the building or construction job shall also include a facility dedicated to the performance of the contract or project and in close proximity to the actual construction location so it would be reasonable to include it.
