Synopsis As Introduced
Amends the Department of Human Services (Alcoholism and Substance Abuse) Law of the Civil Administrative Code of Illinois. Provides that any person who is required to submit to a drug test within the State must pay a $2 fee. Provides that the funds shall be deposited into a special fund in the State treasury and may be used to make grants to drug courts for certain specified purposes. Creates the position of Statewide Drug Court Coordinator within the Department of Human Services. Amends the State Finance Act to make conforming changes.

House Amendment No. 1
Deletes everything after the enacting clause. Reinserts the provisions of the introduced bill. Exempts persons who are tested under the Omnibus Transportation Employee Testing Act of 1991 from paying the $2 fee. Provides that fees that are collected because of a drug test performed pursuant to a court order by a local probation department or TASC in a county that has established a drug court shall be remitted to the county treasurer who shall deposit the moneys into a special fund created for the operation of the county drug court. Provides that other moneys shall be remitted to the Department of Human Services (instead of the State Treasurer) and deposited into the Drug Treatment and Rehabilitation Fund.

Deletes everything after the enacting clause. Amends the Alcoholism and Other Drug Abuse and Dependency Act. Provides that, subject to appropriation, the Division of Alcoholism and Substance Abuse within the Department of Human Services shall establish a program to administer grants to local drug courts. Sets forth the purposes for which grant moneys may be used. Creates the office of the Statewide Drug Court Coordinator within the Division of Alcoholism and Substance Abuse. Sets forth the duties of the Statewide Drug Court Coordinator.
