Synopsis As Introduced
Amends the Illinois Income Tax Act. Deletes the provision that refunds with respect to the earned income tax credit are subject to the availability of funds from the federal Temporary Assistance for Needy Families Block Grant and the State's ability to meet its required Maintenance of Effort. Effective immediately.

Deletes everything after the enacting clause. Amends the Cigarette Tax Act and the Cigarette Use Tax Act. Increases the taxes under the Acts by an additional 37.5 mills per cigarette. Requires that all of the moneys received by the Department of Revenue from the additional taxes imposed must be paid into the General Revenue Fund. Provides that through August 31, 2007, persons holding valid licenses as distributors may purchase cigarette tax stamps up to an amount equal to 115% of the distributor's average monthly cigarette tax stamp purchases over the 12 calendar months prior to the effective date of this amendatory Act. Amends the General Obligation Bond Act. Requires that the amounts from the additional taxes that are paid into the General Revenue Fund be transferred to the General Obligation Bond Retirement and Interest Fund. Effective immediately.

Deletes everything after the enacting clause. Reinserts the provisions of the bill as amended by Senate Amendment No. 3 with the following changes: Amends the State Finance Act to create the Healthcare Provider Relief Fund for use by Department of Healthcare and Family Services only for the purpose of making reimbursements to providers of goods or services under certain programs. Deletes provisions amending the General Obligation Bond Act requiring that the amounts from the additional taxes that are paid into the General Revenue Fund be transferred to the General Obligation Bond Retirement and Interest Fund. In the Cigarette Tax Act and the Cigarette Use Tax Act, requires that the proceeds of the additional taxes be paid into the Tax Compliance and Enforcement Fund, the Healthcare Provider Relief Fund, and the Pension Stabilization Fund. In the Counties Code, provides that the county cigarette tax applies only to the counties of Lake, McHenry, Kane, DuPage, and Will. Provides that the tax rate must be 50 mills per cigarette. Amends the State Finance Act. Exempts the Tax Compliance and Enforcement Fund and the Healthcare Provider Relief Fund from the Act's administrative charge-back provisions. Makes other changes. Effective immediately.

Senate Floor Amendment No. 9
Deletes the immediate effective date provision. In the Cigarette Tax Act and the Cigarette Use Tax Act, changes the beginning date of the additional tax imposed from September 1, 2007 to June 1, 2008.

 Fiscal Note, Senate Floor Amendment No. 6 (Dept. of Revenue)
 HB 556 (S-AM 6) would increase Cigarette Tax and Cigarette Use Tax revenues, but the amount of the increase depends upon how many counties impose a county Cigarette Tax. If no counties impose a county cigarette tax, State Cigarette Tax and Cigarette Use Tax revenues would increase by approximately $410 million per year. If Lake, McHenry, Kane, DuPage, and Will Counties all impose a county cigarette tax, State Cigarette Tax and Cigarette Use Tax revenues would increase by approximately $220 million per year.
