Synopsis As Introduced
Amends the Children and Family Services Act. Provides that, if the person who gives, donates, or bequeaths money or other property to children under the care of the Department provides in writing that it is to be used for a specific purpose, the Department shall use the money or other property only for that purpose. Provides that on and after October 1, 2007, subject to appropriation, all youths emancipated from the Department are eligible to receive a payment from the Department not to exceed $1,500 for the purpose of promoting successful transition outcomes by supporting initial housing and living expenses for the recipient. Requires the Department to establish rules concerning (i) eligibility criteria for the receipt of funds under this paragraph and (ii) a process for disseminating the payments. Effective July 1, 2007.

House Amendment No. 1
Deletes provisions concerning payments to youths emancipated from the Department. Provides instead that, subject to appropriation, the Department shall provide a stipend in the amount of up to $1,500 to youths who, on or after January 1, 2008, cease to be wards of the Department and who meet certain qualifications. Provides that the stipend shall be paid by voucher to promote successful transition outcomes by supporting training, housing, and living expenses and may also be used to pay the fee for drivers education to prepare the youth to take an examination for a drivers license or permit. Provides that, in order to be eligible for this benefit, a youth must have: (A) at the time wardship terminated, reached the age of 18 years or older; and (B) either (i) at the time wardship terminated, obtained a certificate of graduation from a high school or the recognized equivalent of such a certificate; (ii) within one year after wardship terminated, obtained a certificate of graduation from a high school or the recognized equivalent of such a certificate, or (iii) within one year after wardship terminated, been determined by DCFS to lack the ability to obtain a certificate of graduation from a high school, or the recognized equivalent of such a certificate, due to an impairment or disability. Provides that the Department shall establish by rule (i) procedures for verifying eligibility for the receipt of the stipend and for determining the amount of the stipend to be awarded and (ii) a process for disseminating the payments.
