Synopsis As Introduced
Amends the Regulatory Sunset Act to change the repeal date of the Home Medical Equipment and Services Provider License Act from January 1, 2008 to January 1, 2018. Effective immediately.

Amends the Home Medical Equipment and Services Provider License Act. Changes references from "Department of Professional Regulation" to "Department of Financial and Professional Regulation" and from "Director of Professional Regulation" to "Secretary of Financial and Professional Regulation" throughout the Act. Removes a provision that requires the Department to issue a quarterly report to the Home Medical Equipment and Services Board of the status of all complaints related to the profession filed with the Department. Makes changes in a Section concerning the Board, including removing a provision that allows the Board to recommend to the Department rules that specify the medical equipment to be included under the Act, that set standards for licensure, professional conduct, and discipline of entities that provide home medical equipment and services, and that govern the safety and quality of home medical equipment and services. Makes changes in a Section concerning grounds for disciplinary action, including allowing the Department to impose a fine not to exceed $10,000 (instead of $1,000) for each violation and setting forth additional grounds for discipline under the Act. Provides for a civil penalty of $10,000 (instead of $5,000) to be paid to the Department for each offense of unlicensed practice. Allows the Department to inspect a licensee for compliance with the Act and to conduct random inspections upon renewal of a license (instead of requiring such inspections). Makes other changes. Repeals Sections concerning the initial issuance of a license under the Act and entities engaged in the profession prior to the effective date of the Act.

House Amendment No. 2
In the Section of the Home Medical Equipment and Services Provider License Act concerning the appointment of a hearing officer, sets forth a procedure for direct appeal by the respondent if the Home Medical Equipment and Services Board does not present its findings of fact, conclusions of law, and recommendations to the Secretary of Financial and Professional Regulation within a certain time period after receipt of the hearing officer's report, and provides for the adoption of the hearing officer's report as a final decision of the Secretary upon the Secretary's failure to issue an order within 30 days after the Board's failure to report.
