Synopsis As Introduced
Amends the Regulatory Sunset Act to change the repeal date of the Marriage and Family Therapy Licensing Act from January 1, 2008 to January 1, 2018. Effective immediately.

Amends the Marriage and Family Therapy Licensing Act. Changes references from "Department of Professional Regulation" to "Department of Financial and Professional Regulation" and from "Director of Professional Regulation" to "Secretary of Financial and Professional Regulation" throughout the Act. Makes changes in provisions concerning applications for licensure and licensure by endorsement. Allows the Department to take any disciplinary or non-disciplinary (now, just disciplinary) action that it may deem proper, including fines not to exceed $10,000 (now $1,000) for each violation of the Act. Makes other changes concerning grounds for disciplinary action, including changing the number of days that a licensee has to provide information in response to a written request made by the Department from 60 to 30 and the number of days within which a hearing must be convened after a person's license is suspended from 15 to 30. Adds a provision prohibiting unlicensed practice of the profession and allowing the Department to impose a civil penalty not to exceed $10,000 for each offense of unlicensed practice. Makes changes in provisions concerning hearing officers.

House Amendment No. 2
In the Section of the Marriage and Family Therapy Licensing Act concerning the appointment of a hearing officer, sets forth a procedure for direct appeal by the respondent if the Illinois Marriage and Family Therapy Licensing and Disciplinary Board does not present its findings of fact, conclusions of law, and recommendations to the Secretary of Financial and Professional Regulation within a certain time period after receipt of the hearing officer's report, and provides for the adoption of the hearing officer's report as a final decision of the Secretary upon the Secretary's failure to issue an order within 30 days after the Board's failure to report.
