Synopsis As Introduced
Amends the Riverboat Gambling Act. Provides that applications for owners licenses shall be considered in accordance with the rules of the Illinois Gaming Board (deleting statutory deadlines for filing the applications). Makes changes in provisions concerning the determining factors in the Board's decision in granting owners licenses. Makes changes concerning the criteria for an occupational license. Provides that excursion cruises shall not exceed 4 hours for a round trip, but that the Board may grant express approval for an extended cruise on a case-by-case basis. Provides exceptions to the requirement that gambling equipment and supplies must be purchased or leased only from suppliers licensed under the Act. Provides that any winnings that are a result of a wager by a person under age 21 shall be treated as winnings for privilege tax purposes, confiscated, and forfeited to the State and deposited into the Education Assistance Fund. Provides that the privilege tax shall be paid to the Board not later than 5:00 (was 3:00) o'clock p.m. of the day after the day when the wagers were made. Provides that a person under the age of 21 who enters upon a riverboat commits a petty offense and is subject to a fine. Makes other changes. Effective immediately.

Replaces everything after the enacting clause. Creates the Illinois Casino Development Authority Act. Creates the Illinois Casino Development Authority and vests its powers in the Illinois Casino Development Board. Provides that the Board shall select casino operators to develop and operate a land-based casino in Chicago. Amends the Department of Commerce and Economic Opportunity Law to create the Depressed Communities Economic Development Board. Reenacts the provisions of Public Act 94-804, and changes the provisions amending the Riverboat Gambling Act requiring certain owners licensees pay 3% of their adjusted gross receipts into the Horse Racing Equity Trust Fund by removing the 2-year limitation on the payments and requiring all owners licensees to pay a scaled percentage based on annual gross gaming receipts. Amends the Illinois Horse Racing Act of 1975. Allows advance deposit wagering. Deletes provisions concerning the Horse Racing Equity Fund. Creates the Backstretch Programs Advisory Board. Makes other changes. Amends the Riverboat Gambling Act. Authorizes the issuance of a license to conduct land-based casino gambling in Chicago. Allows the Authority to receive an owners license to conduct land-based casino gambling within that municipality. Changes the short title to the Riverboat and Casino Gambling Act and makes corresponding changes in other Acts. Authorizes the Illinois Gaming Board to issue 3 owners licenses to conduct riverboat gambling that are in addition to the 10 owners licenses authorized under current law. Provides that the new positions shall be subject to competitive bidding. Allows an owners license to conduct electronic poker. Allows an owners licensee to purchase gaming positions in addition to the gaming positions authorized under current law. Makes changes concerning the admission tax rate and the distribution of wagering tax moneys. Makes other changes. Amends the State Finance Act to create the Racing Industry Workers' Fund and the Depressed Communities Economic Development Fund. Contains an inseverability clause in relation to the amendatory provisions. Preempts home rule. Effective immediately.

Senate Floor Amendment No. 4
In provisions concerning the Depressed Communities Economic Development Board, adds zip codes to the list of zip codes that are designated as Illinois depressed communities. In the recapture provisions of the Illinois Horse Racing Act of 1975, provides that those provisions apply only until an organization licensee for the race track affiliated with a wagering facility receives its first payment from the impact fee imposed under the Riverboat and Casino Gambling Act. In provisions amending the Riverboat Gambling (and Casino) Act, (i) adds a definition of "electronic poker"; (ii) provides that one of the licenses shall authorize the conduct of riverboat gambling operations within 4 miles (rather than 5 miles) of any portion of O'Hare International Airport; (iii) authorizes the sale of a total of 600 positions to minority person-owned businesses or female-owned businesses pursuant to competitive bidding, provides that no minority person-owned business or female-owned business may purchase more than 50 positions, and provides that these positions may be leased to an owners licensee; (iv) allows a licensee holding 3 or more licenses on May 31, 2007 to continue to hold those licenses; (v) incorporates the privilege tax provisions for electronic poker into the current provisions imposing privilege taxes; (vi) includes language including the minority person-owned or female-owned positions in the current provisions imposing privilege taxes; (vii) reduces the amount that the municipality in which the casino is located receives from the tax revenue deposited into the State Gaming Fund from 20% to 5%; (viii) requires an owners license issued on or after the effective date authorizing riverboat or casino gambling (rather than just riverboat gambling) to pay a specified percentage of its gross gaming receipts to Cook County; (ix) provides that, for the imposition of certain privilege taxes, certain amounts paid into the Horse Racing Equity Trust Fund shall not be included in the determination of annual gross gaming receipts; (x) provides for a specified distribution of gross gaming receipts from the new positions to be divided equally among State universities, rather than 25% to Chicago State University and 75% to the other public universities based on the number of campuses of the university; and (xi) corrects internal references.

Senate Floor Amendment No. 6
Limits the total number of gaming positions operated at one time by an owners licensee, other than the Chicago casino, to 3,500. Limits the total number of gaming positions operated at one time by the Chicago casino to 4,000.
