| SENATE JOINT RESOLUTION
|
| 2 |
| WHEREAS, The increasing cost of medical liability |
| 3 |
| insurance results in increased financial burdens upon |
| 4 |
| physicians and hospitals; and
|
| 5 |
| WHEREAS, Various groups have cited data to support the |
| 6 |
| contention that frivolous medical malpractice suits and |
| 7 |
| excessive medical malpractice judgments are the cause of this |
| 8 |
| crisis; and
|
| 9 |
| WHEREAS, Other groups have cited other data in support of |
| 10 |
| their claims that medical malpractice suits and judgments are |
| 11 |
| not the cause of the crisis but that the medical liability |
| 12 |
| insurance industry is actually at the root of the crisis; and
|
| 13 |
| WHEREAS, The collection of information in court records can |
| 14 |
| play an important role in helping the citizens of this State |
| 15 |
| determine the degree to which the legal system and the cost of |
| 16 |
| medical liability insurance are related; therefore, be it
|
| 17 |
| RESOLVED, BY THE SENATE OF THE NINETY-FOURTH GENERAL |
| 18 |
| ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES |
| 19 |
| CONCURRING HEREIN, that we request the Supreme Court to modify |
| 20 |
| its administrative orders to provide for specific medical |
| 21 |
| malpractice case recordkeeping by circuit court clerks and |
| 22 |
| reporting of this information to the public and the Department |
| 23 |
| of Financial and Professional Regulation; and be it further
|
| 24 |
| RESOLVED, That we request the Supreme Court to order a new |
| 25 |
| case designation of "MM" to be used in medical malpractice |
| 26 |
| cases filed in the circuit court; and be it further
|
| 27 |
| RESOLVED, That a copy of this resolution be delivered to |
| 28 |
| the Chief Justice of
the Illinois Supreme Court.
