Amends the Good Samaritan Act. Provides that any person who provides first aid, in good faith and without fee, is exempt from a claim from the person aided for civil damages for any act or omission in providing the aid, except willful and wanton misconduct. (At present, the exemption from liability is limited to persons with a current certification in first aid issued by the American Red Cross or the American Heart Association.) Effective immediately.

| AN ACT concerning civil law.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Good Samaritan Act is amended by changing |
5 |
| Section 67 as follows: |

| (745 ILCS 49/67) |

| Sec. 67. First aid providers; exemption for first aid. Any |
8 |
| person who is currently certified in first aid by the American |
9 |
| Red Cross or the American Heart Association and who in good |
10 |
| faith provides first aid without fee to any person shall not, |
11 |
| as a result of his or her acts or omissions, except willful and |
12 |
| wanton misconduct on the part of the person in providing the |
13 |
| aid, be liable to a person to whom such aid is provided for |
14 |
| civil damages. |

| The provisions of this Section shall not apply to any |
16 |
| health care facility as defined in Section 8-2001 of the Code |
17 |
| of Civil Procedure or to any practitioner as defined in Section |
18 |
| 8-2003 of the Code of Civil Procedure providing services in a |
19 |
| hospital or health care facility.

| Section 99. Effective date. This Act takes effect upon |
