| AN ACT concerning regulation.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 1. Short title. This Act may be cited as the |
5 |
| Genetic Discrimination in Employment Prohibition Act. |
6 |
| Section 5. Purpose. Genetic discrimination occurs in an |
7 |
| employment setting when predictive genetic information is used |
8 |
| to treat people differently in employment, termination, |
9 |
| promotion, or healthcare or insurance provision decisions |
10 |
| based on the belief that a genetic marker indicates that an |
11 |
| applicant or employee may become too sick to work or too costly |
12 |
| to insure. The prohibition of genetic discrimination in |
13 |
| employment is declared to affect the health, safety, and |
14 |
| welfare of the public. |

| Section 10. Genetic discrimination defined. "Genetic |
16 |
| discrimination" means discrimination perpetrated against a |
17 |
| person based on predictive genetic information obtained |
18 |
| concerning that person. |
19 |
| Section 15. Genetic discrimination prohibited. It is |
20 |
| unlawful for any employer or potential employer to engage in |
21 |
| genetic discrimination against any employee or applicant for |
22 |
| employment. The predictive genetic information of any employee |
23 |
| or applicant for employment may play no part in any employment, |
24 |
| termination, promotion, or health care or insurance provision |
25 |
| decision made by an employer.
