Amends the Surface Coal Mining Land Conservation and Reclamation Act. Provides that on or after the effective date of the amendatory Act, no initial permit shall be issued and no existing permit shall be revised or renewed for mining on land that measures less than 300 feet away from an area that has been designated a national scenic byway by the United States Department of Transportation. Effective immediately.

| AN ACT concerning regulation.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Surface Coal Mining Land Conservation and |
5 |
| Reclamation Act is amended by adding Section 2.12 as follows: |

| (225 ILCS 720/2.12 new) |

| Sec. 2.12. National scenic byway permit prohibition. On or |
8 |
| after the effective date of this amendatory Act of the 94th |
9 |
| General Assembly, no initial permit shall be issued and no |
10 |
| existing permit shall be revised or renewed for mining on land |
11 |
| that measures less than 300 feet away from an area that has |
12 |
| been designated a national scenic byway by the United States |
13 |
| Department of Transportation.

| Section 99. Effective date. This Act takes effect upon |
15 |
| becoming law.
