| AN ACT concerning regulation.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Nursing Home Care Act is amended by changing |
5 |
| Section 3-421 as follows:
|

| (210 ILCS 45/3-421) (from Ch. 111 1/2, par. 4153-421)

| Sec. 3-421. In any transfer or discharge conducted under |
8 |
| subsection (e)
of Section 3-415, the Department shall notify |
9 |
| the facility and any resident
to be removed that an emergency |
10 |
| has been found to exist and removal
has been ordered, and shall |
11 |
| involve the residents in removal planning if
possible. With the |
12 |
| consent of the resident or his or her representative, the |
13 |
| facility must inform the resident's designated case |
14 |
| coordination unit, as defined in 89 Ill. Adm. Code 240.260, of |
15 |
| the resident's pending discharge and must provide the resident |
16 |
| or his or her representative with the case coordination unit's |
17 |
| telephone number and other contact information. Following |
18 |
| emergency removal, the Department shall provide written
notice |
19 |
| to the facility, to the resident, to the resident's |
20 |
| representative,
if any, and to a member of the resident's |
21 |
| family, where practicable, of
the basis for the finding that an |
22 |
| emergency existed and of the right to
challenge removal under |
23 |
| Section 3-422.
