SYNOPSIS AS INTRODUCED:
 
210 ILCS 45/3-421   from Ch. 111 1/2, par. 4153-421

    Amends the Nursing Home Care Act. Provides that pending approval from the resident, a nursing home must inform the resident's designated case coordination unit of the resident's pending discharge and must provide the resident or his or her representative with the case coordination unit's telephone number and other contact information. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing Home Care Act is amended by changing
5 Section 3-421 as follows:
 
6     (210 ILCS 45/3-421)  (from Ch. 111 1/2, par. 4153-421)
7     Sec. 3-421. In any transfer or discharge conducted under
8 subsection (e) of Section 3-415, the Department shall notify
9 the facility and any resident to be removed that an emergency
10 has been found to exist and removal has been ordered, and shall
11 involve the residents in removal planning if possible.
12 Following emergency removal, the Department shall provide
13 written notice to the facility, to the resident, to the
14 resident's representative, if any, and to a member of the
15 resident's family, where practicable, of the basis for the
16 finding that an emergency existed and of the right to challenge
17 removal under Section 3-422. Pending approval from the
18 resident, the facility must inform the resident's designated
19 case coordination unit, as defined in Ill. Admin. Code 240.260,
20 of the resident's pending discharge and must provide the
21 resident or his or her representative with the case
22 coordination unit's telephone number and other contact
23 information.

25     Section 99. Effective date. This Act takes effect upon
26 becoming law.
