| AN ACT concerning health.
|
2 |
| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Clean Indoor Air Act is amended by |
5 |
| changing Section 3 as follows:
|

| Sec. 3. For the
the purposes of this Act, the following |
8 |
| terms have the
meanings ascribed to them in this Section unless |
9 |
| different meanings are
plainly indicated by the context: |
10 |
| (a) "Department" means the Department of Public Health.
|
11 |
| (b) "Proprietor" means any individual or his designated |
12 |
| agent who by
virtue of his office, position, authority, or |
13 |
| duties has legal or
administrative responsibility for the use |
14 |
| or operation of property.
|
15 |
| (c) "Public Place" means any enclosed indoor area used by |
16 |
| the
public or serving as a place of work including, but not |
17 |
| limited to,
hospitals, restaurants, retail stores, offices, |
18 |
| commercial establishments,
elevators, indoor theaters, |
19 |
| libraries, art museums, concert halls, public
conveyances, |
20 |
| educational facilities, nursing homes, auditoriums, arenas,
|
21 |
| and meeting rooms, but excluding bowling establishments and |
22 |
| excluding places
whose primary business is the sale of |
23 |
| alcoholic beverages for consumption
on the premises and |
24 |
| excluding rooms rented for the purpose of living
quarters or |
25 |
| sleeping or housekeeping accommodations from a hotel, as
|
26 |
| defined in the Hotel Operators' Occupation Tax Act, and |
27 |
| private, enclosed
offices occupied exclusively by smokers, |
28 |
| even though such offices may be
visited by nonsmokers.
|
29 |
| (d) "Smoking" means the act of inhaling the smoke from or |
30 |
| possessing a
lighted cigarette, cigar, pipe, or any other form |
31 |
| of tobacco or similar
substance used for smoking.
|
32 |
| (e) "State agency" has the meaning formerly ascribed to it |
