Amends the Criminal Code of 1961. Provides that a person also commits robbery when he or she withdraws, takes, or transfers funds from the
financial account of another or obtains the account number, personal
identification number, or other information used to access
the financial account of another by the use of force or by threatening the imminent use of force, by, or for the purpose of, accessing any financial account through the use of an automatic teller machine.
Provides that a person convicted of such robbery is not eligible to receive a sentence of probation or conditional discharge. Effective immediately.

| AN ACT concerning criminal law.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by changing |
5 |
| Section 18-1 as follows:
|

| (720 ILCS 5/18-1) (from Ch. 38, par. 18-1)

| Sec. 18-1. Robbery.
|
8 |
| (a) A person commits robbery when he or she takes property, |
9 |
| except a
motor vehicle covered by Section 18-3 or 18-4,
from |
10 |
| the person or presence of another by the use of force or by
|
11 |
| threatening the imminent use of force.
|
12 |
| (a-5) A person commits robbery when he or she withdraws, |
13 |
| takes, or transfers funds from the
financial account of another |
14 |
| or obtains the account number, personal
identification number, |
15 |
| or other information used to access
the financial account of |
16 |
| another by the use of force or by threatening the imminent use |
17 |
| of force, by, or for the purpose of, accessing any financial |
18 |
| account through the use of an automatic teller machine. |

| (b) Sentence.
|
20 |
| Robbery is a Class 2 felony. However, if the victim is 60 |
21 |
| years of age
or over or is a physically handicapped person, or |
22 |
| if the robbery is
committed
in a school or place of worship, |
23 |
| robbery is a Class 1 felony. A person convicted of robbery |
24 |
| under subsection (a-5) of this Section is not eligible to |
25 |
| receive a sentence of probation or conditional discharge.

| Section 99. Effective date. This Act takes effect upon |
