Amends the Environmental Protection Act to reflect the Illinois Emergency Management Agency's assumption of duties assigned to IEMA's predecessor, the Department of Nuclear Safety. Effective immediately.

| AN ACT concerning safety.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|
4 |
| Section 5. The Environmental Protection Act is amended by |
5 |
| changing Sections 25a-1 and 25b as follows:
|
6 |
| (415 ILCS 5/25a-1) (from Ch. 111 1/2, par. 1025a-1)
|

| Sec. 25a-1. At least 60 days before beginning the |
8 |
| decommissioning of
any nuclear power plant located in this |
9 |
| State, the owner or operator of
the plant shall file, for |
10 |
| information purposes only, a copy of the
decommissioning plan |
11 |
| for the plant with the Environmental Protection Agency and a |
12 |
| copy with the
Illinois Emergency Management Agency
Department |
13 |
| of Nuclear Safety .

| Sec. 25b. Any person, corporation or public authority |
17 |
| intending to
construct a nuclear steam-generating facility or a |
18 |
| nuclear fuel
reprocessing plant shall file with the Illinois |
19 |
| Emergency Management Agency
Department of Nuclear Safety an
|
20 |
| environmental feasibility report which incorporates the data |
21 |
| provided in
the preliminary safety analysis required to be |
22 |
| filed with the United States
Nuclear Regulatory Commission. The |
23 |
| Board may by rule prescribe the form of
such report. The Board |
24 |
| shall have the power to adopt standards to protect
the health, |
25 |
| safety and welfare of the citizens of Illinois from the hazards
|
26 |
| of radiation to the extent that such powers are not preempted |
27 |
| under the
federal constitution.

| Section 99. Effective date. This Act takes effect upon |

| becoming law.
