Amends the Public Utilities Act. Repeals provisions requiring the Illinois Commerce Commission: (i) to collect information relating to the acquisition or sale of emission allowances under federal law from each public utility and each affiliated interest of a public utility owning an electric generating station and (ii) to adopt rules concerning the policies and procedures to be utilized in evaluating and deciding any requests for the recovery and allocation of reasonable and prudent costs incurred in the construction of generation or production facilities that have been cancelled. Deletes a provision prohibiting the Commission from requiring or implementing any system or means for the dispatch or brokering of power from a central location unless and until such action is recommended, after notice and a hearing, by a majority of the entire Commission and expressly authorized by the General Assembly upon consideration of the Commission's recommendation. Effective immediately.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Public Utilities Act is amended by repealing |
7 |
| Sections 4-305 and 9-216. |

| Section 10. The Public Utilities Act is amended by changing |

| Section 8-405 as follows:

| Sec. 8-405. Strategic options for changing the structure of |

| energy services markets.
The Commission is authorized, to the |
13 |
| extent consistent with
its energy supply planning |

| responsibilities and the energy supply planning
objectives of |
15 |
| this Act, to study strategic options for changing the
structure |
16 |
| of energy services markets when (a) such study is authorized by |
17 |
| a
vote of the full Commission; (b) the study findings are |
18 |
| subject to full
public hearings and opportunity for comment; |
19 |
| and (c) the study findings and
any findings from public |
20 |
| hearings are fully reported to the General
Assembly together |
21 |
| with any recommendations adopted by a vote of the
Commission |
22 |
| concerning the need for legislative action.
|
23 |
| Notwithstanding any provision to the contrary the |
24 |
| Commission shall not
require or implement any system or means |
25 |
| for the dispatch or brokering of
power from a central location |
