Creates the Illinois State Diabetes Commission Act. Establishes the Illinois State Diabetes Commission. Sets forth term lengths of members and provides that members shall be reimbursed only for reasonable and necessary expenses. Requires the Department of Public Health to provide administrative support for the Commission. Sets forth duties of the Commission. Permits the Department to accept on behalf of the Commission any federal funds or gifts and donations from individuals, private organizations, and foundations. Repeals the Act on January 1, 2010. Effective November 1, 2006.

| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|
4 |
| Section 1. Short title. This Act may be cited as the |
5 |
| Illinois State Diabetes Commission Act. |
6 |
| Section 5. Illinois State Diabetes Commission. There is |
7 |
| hereby established within the Department of Public Health the |
8 |
| Illinois State Diabetes Commission. The Commission shall |
9 |
| consist of at
least 9 members that are residents of this State. |
10 |
| The members of the Commission shall be appointed by the |
11 |
| Governor as follows: |
12 |
| (1) The Director of Public Health or the Director's |
13 |
| designee, who shall serve as chairperson of the Commission. |
14 |
| (2) Two physicians who are board certified in |
15 |
| endocrinology, with at least one physician with expertise |
16 |
| and experience in the treatment of
childhood diabetes and |
17 |
| at least one physician with expertise and experience in the
|
18 |
| treatment of adult onset diabetes. |
19 |
| (3) Two health care professionals with expertise and |
20 |
| experience in the prevention,
treatment, and control of |
21 |
| diabetes. |
22 |
| (4) One representative of the American Diabetes |
23 |
| Association. |
24 |
| (5) One representative of a voluntary health |
25 |
| organization or advocacy group with
an interest in the |
26 |
| prevention, treatment, and control of diabetes. |
27 |
| (6) Two members of the public who have been diagnosed |
28 |
| with diabetes. |
29 |
| The Director of Public Health may appoint up to 8 |
30 |
| additional members deemed necessary and appropriate by the |
31 |
| Director. |

| Section 10. Members; meetings. Members of the Commission |
2 |
| shall be appointed by December 1, 2006. Of the
initial members |
3 |
| appointed to the Commission, 5 members shall serve a term of 2 |
4 |
| years and
4 members shall serve a term of one year. Thereafter, |
5 |
| members shall serve a term
of 2 years. Any additional member |
6 |
| appointed by the Director of Public Health under Section 5 of |
7 |
| this Act shall serve a term of one year. A member shall |
8 |
| continue to serve
until his or her successor is duly appointed |
9 |
| and qualified. Vacancies shall be filled in the same manner as |
10 |
| the original appointments, and any member so appointed shall |
11 |
| serve during the remainder of the term for which the vacancy |
12 |
| occurred. |
13 |
| Meetings shall be held at least every 90 days or at the |
14 |
| call of the Commission chairperson.

| Section 15. Reimbursement. Members shall serve without |
16 |
| compensation but shall, subject to appropriation,
be |
17 |
| reimbursed for reasonable and necessary expenses actually |
18 |
| incurred in the performance
of the member's official duties.
|

| Section 20. Department support of Commission. The |
20 |
| Department of Public Health shall
provide administrative |
21 |
| support and current staff as necessary for the effective |
22 |
| operation
of the Commission.
|
23 |
| Section 25. Duties. The Commission shall perform all of the |
24 |
| following duties: |
25 |
| (1) Hold public hearings to gather information
from the |
26 |
| general public on issues pertaining to the prevention, |
27 |
| treatment, and control of
diabetes. |
28 |
| (2) Develop a strategy for the prevention, treatment, |
29 |
| and control of diabetes
in this State. |
30 |
| (3) Examine the needs of adults, children, racial and |
31 |
| ethnic minorities, and
medically underserved populations |
32 |
| who have diabetes. |
33 |
| (4) Identify the roles and responsibilities of health |

| care professionals in the
prevention and control of |

| diabetes. |

| (5) Provide an annual report on the activities of the |
4 |
| Commission to the Director of
Public Health, the Speaker of |
5 |
| the House of Representatives,
the President of the Senate, |
6 |
| and the Governor by February 1 of each year, beginning on |
7 |
| February 1, 2007.

| Section 30. Funding. The Department of Public Health may |
9 |
| accept on behalf of the
Commission any federal funds or gifts |
10 |
| and donations from individuals, private organizations,
and |
11 |
| foundations and any other funds that may become available.
|
12 |
| Section 90. Repeal. This Act is repealed on January 1, |
13 |
| 2010. |
14 |
| Section 99. Effective date. This Act takes effect November |
15 |
| 1, 2006.
