AMENDMENT TO SENATE BILL 2394

2     AMENDMENT NO. ______. Amend Senate Bill 2394by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5e as follows:
 
6     (305 ILCS 5/5-5e new)
7     Sec. 5-5e. Home and Community Based Services Waivers;
8 "developmental disability". Beginning on July 1, 2007, all Home
9 and Community Based Services Waivers for persons with
10 Developmental Disabilities must define "developmental
11 disability" as a severe, chronic disability of an individual
12 that:
13         (1) is attributable to a mental or physical impairment
14     or combination of mental and physical impairments;
15         (2) is manifested before the individual attains the age
16     of 22;
17         (3) is likely to continue indefinitely;
18         (4) results in substantial functional limitations in 3
19     or more of the following areas of major life activity:
20             (A) self-care;
21             (B) receptive and expressive language;
22             (C) learning;
23             (D) mobility;
24             (E) self-direction;

1             (F) capacity for independent living; and
2             (G) economic self-sufficiency; and
3         (5) reflects the individual's need for a combination
4     and sequence of special, interdisciplinary, or generic
5     services, individualized supports, or other forms of
6     assistance that are of lifelong or extended duration and
7     are individually planned and coordinated.
8     An individual from birth to age 9, inclusive, who has a
9 substantial developmental delay or specific congenital or
10 acquired condition may be considered to have a developmental
11 disability without meeting 3 or more of the criteria described
12 in clauses (1) through (5) of this Section if the individual,
13 without services and supports, has a high probability of
14 meeting those criteria later in life.".
