Amends the Prevailing Wage Act. Provides that the exemption from the Act for suppliers, sellers, or manufactures, when applied to transportation of aggregate materials including, but not limited to, sand and gravel, asphalt, or concrete, shall apply only to employees of those same suppliers, sellers, or manufactures who are engaged in the transportation of those materials and does not extend to any third parties. Effective immediately.

| AN ACT concerning employment.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Prevailing Wage Act is amended by changing |
5 |
| Section 3 as follows:
|

| (820 ILCS 130/3) (from Ch. 48, par. 39s-3)

| Sec. 3.
|
8 |
| (a) Not less than the general prevailing rate of hourly |
9 |
| wages for
work of a similar character on public works in the |
10 |
| locality in which the
work is performed, and not less than the |
11 |
| general prevailing rate of
hourly wages for legal holiday and |
12 |
| overtime work, shall be paid to all
laborers, workers and |
13 |
| mechanics employed by or on behalf of any public
body engaged |
14 |
| in the construction of public works.
Only such laborers, |
15 |
| workers and mechanics as are
directly employed by contractors |
16 |
| or subcontractors in actual
construction work on the site of |
17 |
| the building or construction job, and
laborers, workers and |
18 |
| mechanics engaged in the transportation of
materials and |
19 |
| equipment to or from the site, but not including the
|
20 |
| transportation by the sellers and suppliers or the manufacture |
21 |
| or
processing of materials or equipment, in the execution of |
22 |
| any contract
or contracts for public works with any public body |
23 |
| shall be deemed to be
employed upon public works. The wage for |
24 |
| a tradesman performing maintenance
is equivalent to that of a |
25 |
| tradesman engaged in construction.

| (b) The exemption from this Act for suppliers, sellers, or |
27 |
| manufactures, when applied to transportation of aggregate |
28 |
| materials including, but not limited to, sand and gravel, |
29 |
| asphalt, or concrete, shall apply only to employees of those |
30 |
| same suppliers, sellers, or manufactures who are engaged in the |
31 |
| transportation of those materials and does not extend to any |
32 |
| third parties.
