SYNOPSIS AS INTRODUCED:

    Amends the Board of Higher Education Act. Adds an additional student member to the Board of Higher Education, which person must be a non-traditional undergraduate student who is at least 24 years old and represents the views of non-traditional students, such as a person who is employed or is a parent.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Board of Higher Education Act is amended by
5 changing Sections 2, 3, and 4 as follows:
 
6     (110 ILCS 205/2)  (from Ch. 144, par. 182)
7     Sec. 2. There is created a Board of Higher Education to
8 consist of 16 15 members as follows: 10 members appointed by
9 the Governor, by and with the advice and consent of the Senate;
10 one member of a public university governing board, appointed by
11 the Governor without the advice and consent of the Senate; one
12 member of a private college or university board of trustees,
13 appointed by the Governor without the advice and consent of the
14 Senate; the chairman of the Illinois Community College Board;
15 the chairman of the Illinois Student Assistance Commission; and
16 2 student members a student member selected by the recognized
17 advisory committee of students of the Board of Higher
18 Education, one of whom must be a non-traditional undergraduate
19 student who is at least 24 years old and represents the views
20 of non-traditional students, such as a person who is employed
21 or is a parent. Beginning on July 1, 2005, one of the 10
22 members appointed by the Governor, by and with the advice and
23 consent of the Senate, must be a faculty member at an Illinois
24 public university. The Governor shall designate the Chairman of
25 the Board to serve until a successor is designated. The
26 chairmen of the Board of Trustees of the University of
27 Illinois, the Board of Trustees of Southern Illinois
28 University, the Board of Governors of State Colleges and
29 Universities, and the Board of Regents of Regency Universities
30 shall cease to be members of the Board of Higher Education on
31 the effective date of this amendatory Act of 1995. No more than
32 7 of the members appointed by the Governor, excluding the

1 Chairman, shall be affiliated with the same political party.
2 The 10 members appointed by the Governor with the advice and
3 consent of the Senate shall be citizens of the State and shall
4 be selected, as far as may be practicable, on the basis of
5 their knowledge of, or interest or experience in, problems of
6 higher education. If the Senate is not in session or is in
7 recess, when appointments subject to its confirmation are made,
8 the Governor shall make temporary appointments which shall be
9 subject to subsequent Senate approval.

12     Sec. 3. Terms; vacancies.
13     (a) The members of the Board whose appointments are subject
14 to confirmation by the Senate shall be selected for 6-year
15 terms expiring on January 31 of odd numbered years. Of the
16 initial appointees, however, 2 shall be designated by the
17 Governor to serve until January 31, 1963, 3 until January 31,
18 1965, and 3 until January 31, 1967.
19     Of the 2 appointees to be made by the Governor pursuant to
20 this Act as amended by the 75th General Assembly, one shall be
21 designated to serve until January 31, 1971 and one until
22 January 31, 1973.
23     (b) The members of the Board shall continue to serve after
24 the expiration of their terms until their successors have been
25 appointed.
26     (c) Vacancies on the Board in offices appointed by the
27 Governor shall be filled by appointment by the Governor for the
28 unexpired term. If the appointment is subject to Senate
29 confirmation and the Senate is not in session or is in recess
30 when the appointment is made, the appointee shall serve subject
31 to subsequent Senate approval of the appointment.
32     (d) Each The student member shall serve a term of one year
33 beginning on July 1 of each year, except that the student
34 member initially selected under this amendatory Act of the 94th
35 General Assembly shall serve a term beginning on the date of

1 such selection and expiring on the next succeeding June 30.
2     (e) The member of the Board representing public university
3 governing boards and the member of the Board representing
4 private college and university boards of trustees, who are
5 appointed by the Governor but not subject to confirmation by
6 the Senate, shall serve terms of one year beginning on July 1.

9     Sec. 4. The Board shall hold regular meetings at times
10 specified in its rules. Special or additional meetings may be
11 held on call of the Chairman, or upon a call signed by at least
12 6 members, or upon call of the Governor. Eight A majority of
13 the members of the Board shall constitute a quorum at all its
14 meetings, but the approval of a new unit of instruction,
15 research, or public service for a public institution of higher
16 education, as provided in Section 7 shall require the
17 concurrence of a majority of all the members of the Board.
18     The Chairmen of the Illinois Community College Board and
19 the Illinois Student Assistance Commission holding membership
20 on the Board each may designate an alternate to attend any
21 meeting of the Board, and an alternate so designated shall have
22 all rights and privileges of regular membership while acting
23 for the Chairman who has so designated him or her.
24     The Board may employ and fix the compensation of
25 professional and clerical staff and other assistants,
26 including specialists and consultants, as it may deem
27 necessary, on a full or part time basis.
