SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/3-3034   from Ch. 34, par. 3-3034

    Amends the Counties Code. Provides that if human remains are unclaimed by family or friends, the coroner may bury or, at his or her option, cremate the remains (now, the coroner may only bury). Provides that cremation shall not be utilized if the preservation of the body is necessary or desirable for law enforcement purposes or if information about the deceased indicates that cremation is inconsistent with the religious beliefs of the deceased. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by changing Section
5 3-3034 as follows:
 
6     (55 ILCS 5/3-3034)  (from Ch. 34, par. 3-3034)
7     Sec. 3-3034. Disposition of body. After the inquest the
8 coroner may deliver the body or human remains of the deceased
9 to the family of the deceased or, if there are no family
10 members to accept the body or the remains, then to friends of
11 the deceased, if there be any, but if not, the coroner shall
12 cause the body or the remains to be decently buried or, at the
13 coroner's option, cremated, the expenses to be paid from the
14 property of the deceased, if there is sufficient, if not, by
15 the county. The coroner shall not approve cremation of the body
16 if there is any information indicating that cremation is
17 inconsistent with the religious beliefs of the deceased, or in
18 any case where it is necessary or desirable to preserve the
19 body for law enforcement purposes. If the State Treasurer,
20 pursuant to the Uniform Disposition of Unclaimed Property Act,
21 delivers human remains to the coroner, the coroner shall cause
22 the human remains to be disposed of as provided in this
23 Section.

25     Section 99. Effective date. This Act takes effect upon
26 becoming law.
