Amends the Illinois Municipal Code. Provides that if a municipality has extended sewers or water mains, or both, to another body corporate and politic, the municipality cannot thereafter require the annexation of the property to the municipality as a prerequisite to the continuation and maintenance of such service. Effective immediately.

| AN ACT concerning local government.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Municipal Code is amended by |
5 |
| changing Section 11-149-1 as follows:
|

| (65 ILCS 5/11-149-1) (from Ch. 24, par. 11-149-1)
|

| Sec. 11-149-1. The corporate authorities of a municipality |
8 |
| may provide by
ordinance for the extension and maintenance of |
9 |
| municipal sewers and water
mains, or both, in specified areas |
10 |
| outside the corporate limits. Such
service shall not be |
11 |
| extended, however, unless a majority of the owners of
record of |
12 |
| the real property in the specified area petition the corporate
|
13 |
| authorities for the service. If such service has been provided |
14 |
| to another body corporate and politic, the municipality cannot |
15 |
| thereafter require the annexation of the property to the |
16 |
| municipality as a prerequisite to the continuation and |
17 |
| maintenance of such service.

| Section 99. Effective date. This Act takes effect upon |
